Terms of Service
Version 1.0 · Effective 1 October 2026
These Terms of Service (the "Terms") are a binding agreement between you and LandlordPort (CAC Reg: Software As A Service), a subsidiary of Arkspan Systems Company Limited, operator of the LandlordPort website and applications (the "marketplace"). They govern your access to and use of the marketplace, including browsing, searching, listing property, messaging other users, and making reservations.
Please read these Terms carefully before using the marketplace. By creating an account, browsing, contacting an advertiser, reserving a room, or publishing a listing, you accept these Terms. If you do not agree, do not use the marketplace.
Note: properties, agents and reviews in this build are fictional demo content and are clearly marked as such in the footer. That content is provided for demonstration and is not an offer to sell or let any real property.
1. Acceptance of these terms
You accept these Terms when you create an account, submit an inquiry, make a reservation, publish or submit a listing, or otherwise use the marketplace. The consent line shown at sign-up links to this page so that you can review the Terms before accepting them.
If you use the marketplace on behalf of a business or organisation, you confirm that you have authority to bind that organisation, and "you" includes that organisation. Feature-specific terms (including plan conditions, boost products and reservation policies) supplement these Terms and prevail where they specifically conflict with them.
2. Eligibility and accounts
You must be at least 18 years old, or acting through a business or organisation with the capacity to enter into a binding contract under Nigerian law, to use the marketplace. Accounts are personal to you or to your organisation; you are responsible for all activity that happens under your account.
- Accurate information. Keep your name, contact details, business details and listing information accurate and up to date, and tell us promptly if you suspect unauthorised use of your account.
- Account types. The marketplace offers seeker and guest accounts, Property Advertiser accounts with an organisation workspace and team invitations, tenant portal access by invitation from a landlord or property manager, a lawyer desk for legal practitioners, and restricted staff accounts used to moderate the platform. Each role carries the permissions shown to it in the product.
- Credentials. You are responsible for safeguarding your password and for restricting access to your device. We may suspend access where we reasonably believe an account has been compromised or is being used in breach of these Terms.
3. Our role as a marketplace
LandlordPort is a discovery marketplace for property in Nigeria. Advertisers (estate agents, landlords, property managers, developers and hotel owners) publish listings. Seekers browse and search those listings, send inquiries and messages, save favourites and searches, leave reviews, and reserve stays.
We are an intermediary that provides the technology platform. We are not a party to any sale, tenancy, short-let arrangement, payment plan or hotel reservation made through the marketplace, and we are not your agent, partner, broker or lender in those transactions. Unless these Terms expressly say otherwise (for example, where the marketplace collects a prepaid booking or subscription fee), contracts for property and stays are formed directly between the parties involved, and listing content is supplied by advertisers.
Deals are agreed directly between the parties. We do not own the properties listed, do not set their price or availability, and do not provide legal, survey, valuation or financial advice. Where a dispute arises between you and another user, we may provide reporting and moderation tools, but resolution is primarily between the parties.
4. Advertiser duties and listing standards
If you advertise on the marketplace, you must be authorised to do so: either you own the property or you act for a party authorised to market it. You are responsible for everything you publish, and you agree that listings will:
- be truthful and not misleading, including on price, service charges, availability, location, condition and payment plan terms;
- use photographs and documents you own or are licensed to use, and only show the property in its genuine current state;
- include documents you are entitled to share, correctly labelled (for example a Certificate of Occupancy, Right of Occupancy, Governor's Consent, survey plan or deed of assignment);
- be kept current: mark properties as sold, rented or withdrawn promptly, keep calendars accurate for short-let and hotel listings, and respond honestly to inquiries; and
- comply with all applicable laws, consent requirements and any obligations owed to owners, tenants and residents.
Marketplace listing types include properties for sale, for rent, short lets, land, payment plan and off-plan offers, shops, offices and warehouses, and hotels. Each listing must fit the category it is published under.
5. Prohibited conduct
You must not use the marketplace to:
- publish false, fraudulent or misleading listings, or misrepresent your identity, authority or affiliation;
- impersonate any person or organisation, or attempt to access accounts, systems or data that are not yours;
- post or share content you do not have the right to use, or content that is unlawful, defamatory, harassing, hateful or exploitative;
- send spam, unsolicited commercial messages, or bulk messages to other users;
- manipulate reviews or ratings, including by posting fake reviews or incentivising positive reviews;
- scrape, harvest or copy marketplace data, interfere with the service, introduce malware, or attempt to circumvent moderation, rate limits, access controls or fees; or
- use the marketplace for any unlawful purpose, including money laundering, extortion or advance-fee fraud, or in a way that exposes other users to harm.
Every property page carries a Report this property button. Reports go to the moderation team and are logged for review. Reporting in good faith is protected; using reports to harass is not.
6. Verification and documents
Verification on the marketplace is deliberately limited, and the badge only ever shows what was actually checked. Our review team examines the identity or business documents an advertiser submits at the time of review. A badge confirms that those checks were performed and nothing more.
- Verification does not certify ownership of any listed property, does not guarantee a transaction, and is not a warranty of an advertiser's conduct.
- Documents shown on a listing are supplied by the advertiser, are labelled as such, and are never legal proof of title. Always verify documents independently (with a lawyer, surveyor or the relevant registry) before paying for anything.
- You must inspect any property in person and satisfy yourself as to its condition, title and terms before committing funds. We do not inspect properties on your behalf.
See our verification and safety guide for the full protocol and safety tips.
7. Inquiries, bookings, stays and hotels
When you send an inquiry, we share the details you provide (your name, your contact details, your message and your preferred channel) with the owner of that listing, so they can respond. By inquiring, you agree to be contacted about your inquiry by the advertiser and by us, including by email and in-app notifications. Conversations, saved searches and favourites are stored in your account so you can return to them.
Short lets. Stays at short-let listings are request-to-book: you pick your dates on the listing calendar, the owner or manager approves your request, and you then pay the full stay from your wallet. Bookings cancelled before check-in are credited back to your wallet in full. You are booking with the owner or manager, not with the marketplace.
Hotels. Hotel reservations work differently: you choose your dates and a room type, the hotel confirms the reservation, and you receive a reservation code in the JPM-XXXXXX format to quote at the front desk. The customer-facing payment mode is Book now, pay at property: money is paid at the hotel and the marketplace only provides the reservation platform and your confirmation code; we never take payment for the hotel stay itself, unless a listing expressly offers prepaid booking. A reservation code confirms a reservation, not payment.
Cancellation policies. Hotel cancellation policies come from the hotel and are shown on the listing before you reserve, including any free-cancellation window, cancellation fee or non-refundable terms. Where a listing offers prepaid booking, a qualifying cancellation refunds the amount held by the marketplace back to your wallet according to that policy; outside the free-cancellation window, or under non-refundable terms, contact the hotel directly. For tenancies, sales, land and payment plans, the terms are those agreed directly between you and the other party.
8. Fees, plans, wallet and payments
Using the marketplace as a seeker is free. Advertisers can start on a free plan with a limited number of active listings, and can subscribe to a paid plan for a larger listing allowance and additional capabilities, such as short-let and hotel listings and their reservations, team seats for a workspace, priority placement and included boost credits. Standalone boost products are also available to feature a listing for a set number of days; paid placements are labelled as such.
- Prices. All amounts are in Naira and are shown to you before you pay. Prices are set by us, may change with notice, and the client never supplies a price of its own; the amount charged is the amount displayed at checkout.
- Billing. Plan and boost purchases are checked out through our payment provider. Wallet top-ups are made through the supported gateways (Paystack, Flutterwave or Monnify). Outside production, clearly-labelled demo top-ups may be available; they are a development sandbox and no real money moves.
- The wallet. Your wallet holds a balance you can top up and spend on marketplace features that take payment from the wallet, such as prepaid short-let stays and rent payments. Balances are recorded in a ledger you can see in your account, are not interest-bearing, and cannot be transferred to another user except as a refund or credit allowed by these Terms.
- Refunds. Refunds follow the policy that applied to the payment: a qualifying cancellation of a prepaid stay credits the amount back to your wallet; plan and boost fees are refundable only where required by law or by the specific offer terms presented at checkout.
You are responsible for any taxes and third-party charges arising from your own transactions. We may suspend paid features for non-payment, and we never take a payment without first showing you the amount you are agreeing to pay.
9. Your content and our intellectual property
You keep ownership of the content you post: listings, photographs, documents, messages, reviews and profile information. By posting it, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt, display and distribute that content as needed to operate, promote and improve the marketplace, for example, to display your listing in search results, on property pages and in promotional placements. The licence ends when you remove the content, except for copies already shared with other users or retained for legal or operational reasons.
You confirm that you have the rights and permissions needed to post your content and that it complies with these Terms. Reviews you read on the marketplace are the opinions of other users and are published after moderation checks.
The marketplace itself (its software, design, branding, structure and original content) belongs to us and our licensors, and is protected by intellectual property law. We give you a limited, revocable, non-transferable licence to use the marketplace for its intended purpose in line with these Terms. You must not copy, resell, reverse engineer or exploit any part of the service outside that purpose.
10. Moderation, suspension and termination
We review listings before they are published. Submissions move through draft, review and published states, and a rejected listing shows the reason given by the moderation team so you can correct it and resubmit. Verification applications, reports and reviews are likewise reviewed by staff, and moderation actions are recorded in an append-only audit log.
We may reject, unpublish, pause or remove content, and may suspend or close accounts, where we reasonably believe these Terms or applicable law have been breached, where there is a risk to other users, where we are required to do so by law, or where an account is inactive or has been created in bad faith. Where practicable, we tell you what happened and why, and you may raise the matter with our support team.
You may close your account at any time by contacting support. On termination, your licence to use the marketplace ends, your public content may be removed, and provisions that by their nature should survive (including intellectual property, disclaimers, liability, indemnity and governing law) continue to apply. Our handling of your personal data after termination is described in the Privacy Policy.
11. Disclaimers, limitation of liability and indemnity
Disclaimers
The marketplace is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we make no warranties that the service will be uninterrupted, error-free or secure, or that any listing, review, badge or reservation code is accurate, complete or reliable. Listing content comes from advertisers, verification reflects only the checks performed at review time, and outputs from the AI assistant are general information and not legal, survey, financial or other professional advice.
Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive losses, or for loss of profits, data, goodwill or business opportunity, arising from your use of the marketplace or from any transaction between users. Our total aggregate liability to you for any claim arising out of or relating to these Terms or the marketplace is limited to the total amount you paid to us in the twelve (12) months before the event giving rise to the claim, or ₦10,000 if you have paid nothing.
Nothing in these Terms limits or excludes liability that cannot be limited or excluded under the laws of the Federal Republic of Nigeria, including liability for fraud or for death or personal injury caused by negligence.
Indemnity
You agree to indemnify and hold harmless LandlordPort, Arkspan Systems Company Limited and their officers, employees and agents from and against any claims, damages, losses and reasonable costs arising out of your content, your breach of these Terms, your violation of any law or third-party right, or any transaction you enter into with another user of the marketplace.
12. Changes to these terms
We may update these Terms from time to time. The version marker and effective date at the top of this page always show which version is in force. Where a change is material, we will give reasonable notice by email or through the marketplace before it takes effect.
If you continue to use the marketplace after an updated version takes effect, you accept the updated Terms. If you do not accept them, stop using the marketplace and contact us to close your account before the changes take effect.
13. Governing law and dispute resolution
These Terms and any dispute arising out of or relating to them or to the marketplace are governed by the laws of the Federal Republic of Nigeria, as applied in Plateau State. The courts and tribunals of Plateau State, sitting in Jos, have jurisdiction over those disputes.
Before starting formal proceedings, please contact us and allow a reasonable period for an informal resolution; most concerns can be settled quickly through our support team. Nothing in these Terms affects any mandatory rights you have as a consumer under applicable Nigerian law.
